class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>I forbindelse med opsigelser er det vigtigt at sikre sig juridisk.<\/p><p>Begrundelsen for opsigelsen skal v\u00e6re saglig og berettiget. Dels kan begrundelsen v\u00e6re medarbejderens manglende kvalifikationer eller arbejdsindsats, samarbejdsvanskeligheder eller lignende grunde. Dels kan begrundelsen ligge hos arbejdsgiveren, eksempelvis ved ordrenedgang, indskr\u00e6nkninger eller nedsk\u00e6ringer.<\/p><p>Opsigelsesvarslet er typisk \u00e9n m\u00e5ned for medarbejderen (funktion\u00e6rer) og anciennitetsafh\u00e6ngigt for arbejdsgiveren (se boksen nedenfor). I praksis indeb\u00e6rer dette, at medarbejderen skal have en (normalt skriftlig) advarsel samt et passende tidsrum til at \u00e6ndre p\u00e5 de u\u00f8nskede forhold. Det er vigtigt, at medarbejderen f\u00e5r bortvisningen p\u00e5 skrift for at sikre, at der ikke efterf\u00f8lgende er krav om at stille sin arbejdskraft til r\u00e5dighed. Som funktion\u00e6r vil medarbejderen have ret til l\u00f8n under sin sygdom \u2013 og ellers vil man kunne f\u00e5 sygedagpenge. <br \/><br \/>Er sygeperioden l\u00e6ngere end blot f\u00e5 dage vil arbejdsgiveren kunne anmode om, at medarbejderen dokumenterer sin sygdom \u2013 eksempelvis gennem en \u201dTro-og-love-erkl\u00e6ring\u201d eller en erkl\u00e6ring fra l\u00e6gen.<br \/><br \/>Arbejdsgiveren kan godt opsige en medarbejder under en sygeperiode. Opsigelsen skal dog v\u00e6re sagligt begrundet. Ved vurderingen af om opsigelsen er saglig, skal det bla. unders\u00f8ges, om der har v\u00e6ret afholdt sygefrav\u00e6rssamtaler, sygeperiodens l\u00e6ngde og om sygefrav\u00e6ret giver arbejdsgiveren problemer med at f\u00e5 l\u00f8st de daglige opgaver mm.<br \/><br \/>Mange funktion\u00e6rer har i deres ans\u00e6ttelseskontrakt indf\u00f8jet, at der g\u00e6lder en s\u00e5kaldt \u201d120-dages-regel\u201d ved sygdom. Her indg\u00e5r i et l\u00f8bende rul p\u00e5 12-m\u00e5neder alle sygedage \u2013 og \u201drammer\u201d medarbejderen de 120 sygedage, vil arbejdsgiveren kunne opsige medarbejderen med et forkortet varsel p\u00e5 l\u00f8bende m\u00e5ned + 1 m\u00e5ned. Pr\u00f8vetiden kan ikke v\u00e6re l\u00e6ngere end tre m\u00e5neder, hvilket betyder, at hvis man stadig er ansat p\u00e5 dette tidspunkt, overg\u00e5r man automatisk til de almindelige opsigelsesvarsler.<\/p><p>Under pr\u00f8vetiden har arbejdsgiveren et opsigelsesvarsel overfor funktion\u00e6ren p\u00e5 mindst 14 dage.<\/p><p>Hvis der ikke st\u00e5r andet i kontrakten, end at der er aftalt pr\u00f8vetid, har funktion\u00e6ren i princippet slet intet opsigelsesvarsel, dvs. at man kan forlade ans\u00e6ttelsen fra den ene dag til den anden. Forbuddet g\u00e6lder b\u00e5de under ans\u00e6ttelsen og i op til tre \u00e5r efter endt ans\u00e6ttelsesforhold.<\/p><p>Medarbejderen er altid underlagt en loyalitetspligt i dit ans\u00e6ttelsesforhold. Det betyder, at man ikke m\u00e5 skade sin arbejdsgivers virksomhed ved eksempelvis at starte konkurrerende virksomhed. Man m\u00e5 heller ikke udnytte en s\u00e6rlig viden, som man har f\u00e5et under ans\u00e6ttelsen.
